Market confidence falls again but doesn't plummet

September was a pretty painful month for the Digital Pulse, Chinwag's confidence index for the digital sector. Industry confidence took an almighty whack, so with baited breath and more than a little trepidation, the numbers were crunched for October’s Digital Pulse.

Coping With a Downturn: Monitoring Solvency

In these difficult times Companies must avoid doing business while technically insolvent.

What does this mean?

Unhelpfully the law itself does not define "insolvency". Broadly speaking it means either your company cannot pay its debts as they fall due or its liabilities are greater than its assets. Trading while insolvent triggers various liabilities for those involved and has serious consequences for Directors. In some cases, Directors can become personally liable for the debts of the company and even be disqualified from acting as a Director in the future.

Digital gets the jitters: market and employment confidence shakey

Confidence across the digital sector plunged in September. Chinwag's Digital Pulse, a monthly confidence index for the digital industry, experienced the biggest single month fall (since its inception) of 7.5%. The Digital Pulse has been falling gradually over the last few months, with a slight uplift during the Summer, but this is the first sign of the chills affecting the wider economy may hit Internet businesses hard.

A sharp intake of breath underscores the analysis of this Digital Pulse. The index has been falling slowly for the last few months but the global financial turmoil is clearly affecting the digital sector. The  overall index is down 7.5% this month, but the real wobbles are in current market confidence which has plunged by 9.4% between August and September.

Using third party software

What's the situation when someone develops a game or product based on third party software (with permission) i.e a "vanilla" product or engine that is made available for that purpose - then someone else comes along and uses it?

In true lawyer style I have to say it depends on what the licence terms of the "vanilla" software are.
