There are two related yet distinct things here:

-- The Flash file format is published, and as a regular file format can be
used by anyone for whichever purpose you wish:
http://www.macromedia.com/software/flash/open/spec/contents.html

-- Flash Players are available for zero-cost licensing to those developing
emerging platforms. This is not Open Source, and not publicly available as
the file format itself is. Latest info I have is that implementation is
still in development:
http://www.macromedia.com/software/flash/open/freesource.html

Rephrased, the file format is available to all today, and the upcoming
player kit is under development, with info available through the email on
that page.
