Hi John,
I have been a free-lance scientific illustrator for over 20 years.
This
kind of thing has always been a gray area. Technically, if you are
redrawing
an illustration you need to get permission from the publisher. Then
you need to state "redrawn by permission" associated with the figure
or in the credits. Sometimes the publishers charge for the permission,
sometimes they don't. It would kind of depend also on what you
are doing with the Flash animation. If you are receiving money for it
or
your client is presenting the information as background for their
research
you should get permission. Since most of my illustrations are
anatomical
in nature, I don't worry about it too much, but I am careful not to
copy. After all there are just so many ways that you can draw a
kidney. If you are redrawing something that is unique to that field it
is a different story. To be on
the safe side I would suggest writing the publisher of the text and
asking them
what their policy is.
