If they have done or do something illegal, I'm sure Macromedia will take
the appropriate action. Otherwise as far as I know Swift Generator is
legal.

To make Flash a standard, MM made the swf format open. Though not
official I think they have succeeded but I'm sure some days they say to
themselves, "How could we do that?".
