If you don't use scenes (recommended) then you just put it in on its own
layer. if you need it hide it at times then put it inside a movie clip.

Alternate solutions include:

Putting the button in a separate movie loaded by load movie.

And using the Duplicate Movie feature and make the original movie clip
(MC) invisible and use a duplicate of the MC. Duplicate MCs are created
in the SWF file where there are no scenes so are unaffected by scenes
since they are unaware of their existance, whereas regular MCs are
created in the authoring where scenes exist and limit MCs.
