An interesting point however is to compare internet sales with call centre
sales. If you purchase something over the phone, they never ask you to wait
whilst a 10 minute recording of the T&Cs plays... Instead the Terms are
included in the package when you receive it, and opening and using the
product is equivalent to agreeing to their terms.

I am not sure why this same model is not used for online purchases, and in
fact, it probably should be used for other channels such as iTV or WAP. They
don't show Terms on QVC do they!

The lawyers might however argue that online you can conveniently display the
terms, so you should. It all depends whether your priority is protecting
yourself, or serving the customer. The other question is, does the having
lengths of T&Cs really harm the user experience? Its a bit of a bother, but
most of us now expect it, and just agree without reading. Having 3,000 words
on your new 7110 might be a bit of a bother, but then I doubt there are that
many things you could buy over WAP.

Yep - many people don't read them, but they are vital. Like any product /
service sold or distributed - all come with "conditions". It does have legal
standing, because you usually can't buy or use a product until you have
checked the agreed with T's & C's box. This means that by law, you have
stated that you have understood limitations, etc to the product / service.
Any company can hold this up in court. Anyone who doesn't state "conditions"
is mad - you open yourself up to unlimited liability.
