On 8/1/99, regarding " Re: FLASH: archive ", John Croteau offered the
following:

>Hi all,

>This is not rocker science.

Actually, maybe it is... we keep 'rocking' back and forth here ;-) (sorry,
couldn't resist!)

>There are 2 issues here and they are both
>clear legally and morally.

Well, no they are not, on either count. That was the basic premise of my
last post, the one that started off with me hoping I was about to get an
education. It might be clear to you, John, and that was precisely why I
asked for something more substansive than your opinion, which, if this post
is any indication, is something you are either unwilling or unable to do.
Consequently, I have little choice but to assume that your statements are
little or nothing more than your personal opinion or conjecture worded in
an authoritative manner.

agreed

says who?

>2) There is only one allowable use of the List after it is published.
>That is that of an archive and from number one above you can see only
>Sam Michel has the right to create or authorize an archive.

again, says who?

>Other uses of the List besides personal use and that of an archive would

yeah... again, says who?

>Just because an archive would be useful and other peoople have them does
>not mean Sam has to provide or authorize one.

Agreed, inasmuch as the list owner's participation is involved. However,
you once again assume a number of points vis-a-vis ownership and use (see
above). If those points are not in law valid, then who says permission is
a prerequisite?

The point of my last post, which I will re-ask here, was: Is there in fact
any legal ground on which Mr. Croteau's arguements can be based? The
question he seems to answer in a 'de facto' manner regarding the morality
is another, and indeed far more speculative one... and I don't think, given
his intense interest in the matter, that Mr. Croteau would be the highest
and best authority on that element of the discussion. Where passion and
self-interest are in the mix, morality tends quickly to depreciate.

And once again allow me to repeat from my last post: This, please
understand, is a 'devil's advocate' position I am taking...

And in response to Dorian, where he offered:

>From: Dorian Nisinson <dorianatbway [dot] net>

><soap box>
> John S seems to want to be a help to the list, which is a fine thing.
>It might have been wiser to follow this list for a while longer before
>deciding unilaterally how the list needs to be helped and who was to do
>it. But his intention was good. This is not a bad thing. It just turned
>out badly so far.

On July 22nd I posted the following to this group:

>Subject: FLASH: New Poster...
>Sender: owneratshocker [dot] com
>Precedence: bulk
>Reply-To: flasheratshocker [dot] com
>
>...just wants to say "Hello" and to ask if there is a searchable archive of
>postings to this list so I don't have to ask questions already answered
>hundreds of times!

If that, or anything I offered subsequently on either that thread or this
one is in any way similar to coersive or unilateral, please accept my
apologies! Ask yourself this question: Have I been acting like a 'high
and mighty' authority here? I think not... all I have been doing is
asking questions based on statements made, statements that to the best of
my admittedly limited knowledge have little or no basis in hard fact. And
yes, if there really is 'hard fact' to be known, I really do want to know
about it!
