First, I want to appologize for getting a little testy.
I just couldn't understand how some could come to those conclusions (at
least not that quickly) with the details I had 'sent'. Unfortunately I
had posted the first copy of the post with details and links to myself
and not the List :-).

Hopefully, there will be a searchable archive for this List in the near
future.
I don't think there are any legal problems in providing a searchable
version of the archive. As long as it is done by or with Sam's
authority, there should be no legal problems. The one big problem with
making the archive more available is that it will require more work,
because if there are any copyright infringements in the List, they are
more likely to be spotted and they will have to be removed on request.
Unless they are blatant, there is no real likelyhood of liability unless
they are not removed on request. There is no need to remove anyone's
posts because he requests it, but requests from 3rd parties and their
copyrighted material that was posted by someone else must be removed in
a resonable time period.
It is commonly accepted that there is a defacto agreement by all who
post to a public List or a newsgroup, that these posts may also be
available in a searchable archive provided by that site.
The bottom line is that I nor any other subscriber can opt out of being
in the archive whether it is searchable or not. I would suggest not
offering this option (it is a lot of unneeded work). However, if there
is copyrighted material posted to the List, posted by someone other than
the owner of the copyright, then this material must be removed.
