My feeling is that Napster doesn't fundamentally do anything different from any other search engine. One cannot outlaw Napster without calling into question the very structure of the Internet. Napster isn't guilty of piracy or the facilitation of piracy any more than Yahoo or AltaVista. The record companies need to listen to what Napster is saying (i.e. let's work together), and pay less defensive attention to the volume of interest in Napster's service. I download from Napster from time to time, but to be honest, it's more cost-effective for me to buy a CD I know I want than it is to spend the time searching for, downloading and burning the same mp3s. In other words, what Napster is for me is an avenue to discover new music, which I am then more likely to buy.

I fully support the recording artists' assertion that they deserve compensation for their work. But perhaps the retail value of their work decreases when the need for physical distribution decreases. Certainly the role of the record companies changes. Marketing for music, like marketing for everything else, is simply different today than it's ever been. To them, I say "Make Napster work FOR you." Huge hits deserve to be compensated for, but axing the most innovative and popular form of musical distribution without considering possible partnerships is myopic and self-defeating.
