For several years now, YouTube have been responsive to copyright infringement notices and the technology they now employ in identifying infringing material means that we can now put a vigorous copyright protection strategy in place relatively easily. This has not always been the case in relation to issues such a defamation and invasion of privacy where it has even been difficult to find contact details on the website. Thankfully, however, the situation does seem to be changing so that all manner of legal claims can be advanced by using the following link: http://www.google.com/support/youtube/bin/request.py?hl=en-GB&contact_ty pe=contact_policy&policy=yt&rd=1 The problem with this system is that it all seems rather robotic. The reporting mechanisms prefer users to use online forms and YouTube will not give out emails address or telephone numbers for the staff that receive and consider legal claims. If a claim is rejected, it can be difficult to follow up or get anyone to properly engage in explaining why YouTube might have refused to remove a particular video. It is for this reason that many of our clients prefer for us to initiate and pursue claims on their behalf. We have established links with YouTube and can often have videos removed within 24-48 hours. An additional reason for our clients asking us to assist them with the problem rather than try to deal with it themselves is that YouTube often come back, particular in defamation cases, and seek to rely on US law and the freedom of speech provisions granted by the US constitution in order to reject a defamation claim. In these circumstances, we have to explain to YouTube how the fact that the videos can be seen and cause damage in the UK means that US law is not appropriate. The most obvious reasons clients come to us, however, is so that they can be sure that they cover all bases when complaining about a particular video or taking subsequent legal action against the person responsible for its production and broadcast on YouTube. Whilst an immediate reaction might be to believe that defamation is the only cause of action arising from a damaging video, it may also lead to issue of malicious falsehood, misuse of confidential information / invasion of privacy, copyright Infringement, passing off and trade mark infringement. In circumstances where, for example, a video may not be considered unlawful under US defamation law, it is useful to have other options available. Whilst you may think that there is some self-interest in suggesting that a solicitor is used for these matters, the unavoidable fact is, that whether you use us or another law firm, companies such as YouTube appear to pay more attention of legal notices if they come from a law firm rather than the online forms they recommend you use. We are always happy to give an initial view of any online content which causes concern and to suggest a strategy for dealing with the damage caused by that content as quickly and cost effectively as possible.
