i have reserched this area for our sister company-the law in the US can be quite confusing but the message that came through every time was that a simple letter, once identified, will solve the problem;this has been effective in the UK aswell.
Large corporates use this method and it seems to work- the unfortunate thing is that there are a lot of optimisation companies who are not proffesional enough to refuse requests from their clients
The simple letter trick works so it is about brand and copyright infringement monitoring. There is no bespoke software that does this at present but there is an optimisation comapny that offers online live reporting of your domain's ranked position across keyword combinations and an array of regional engines;it allows you to track your competitors domains aswell so you can keep an eye on if they come up on your brand name keyword and then despatch the letter! The product is called Competition Watch and is part of Webgravity's ASP solution.
