That pretty much sums up the practical position - the pure legal position is
that you cannot use them - Centrica (British Gas) were hauled over the
coals by the data protection registrar for a mailshot about their new
electricity business - they could not even send out something that said
"we'd like to tell you about our electricity business, return the prepaid
card if you don't want to hear about it". It is really important to get it right
at the start as you cannot clean up "dirty" personal data.

Ideally your client should change all the forms on their web site, so
that people have the chance to opt in.
However in the meantime, they should do the following when they
send out any mailings
1) Let the recipient know how to unsubscribe from any mailing
2) Let the recipient how their address was obtained.
Both of these should be promiently displayed at the top of any
mailing
