Subject: UKNM: Competition law/regulation on the web ? -Reply
From: John Enser

Far be it from a lawyer to proffer free legal advice :-) but the main issues
to worry about are:

is the entrant required to make any payment or similar - if so it is likely to
be a problem both from a regulation P.O.V and also as it might attract the
Customs and Excise to levy pool betting duty (worse than VAT)

is it the exercise of skill or is it chance?

is it about predicting future events?

Depending on the answers t o all of these, it may or may not be legal in
the UK.

So far as opening it up to the rest of the world is concerned, it is not
necessarily the case that you have to comply with all the other countries'
rules - they may not be applicable as a matter of law and there may be a
pragmatic view. These things are not new - TV channels like MTV have
been running multi-territory competitions for years with few problems.

Anyone know of any regualtions or experience of running competions on
the web - such as a prize draw ?
Any help or pointers gratefully received.
