Yes, a Privacy Policy at point of data capture is necessary and needs go
further than you state with only a simple clause about recommendation, for
otherwise your data is virtually useless for any (further) purpose. The
policy needs tell users what you will do with the data you collect, who
accesses, secure, (etc).

Also, you need 2 opt-out (or opt-in boxes!) for recording the users choice
of whether (1)they wish to receive info of further offers from yourselves,
and (2)whether they wish to receive further offers from other carefully
selected third parties.

If you intend to do more than recommend the site to the recipient (unwise),
so you want to market to them, then you need direct recipient to Privacy
Policy, or give them same opt-out boxes. Though, really you should just
reassure recipient that they aren't added to any list - just link them to
visit the site.

But, surely the tell-a-friend mechanism shouldn't be vetoed.

Perhaps frustrating thing ultimately might be misuse...

A tell-a-friend mechanism (like found at
http://www.uk.laterooms.com/eaf.php3?lang=eng ) has been proposed for a
client micro-site. Client legal department has indicated that this cannot
proceed as a)the person receiving the email have not consented to their
email address being recorded and b)the email address could be personally
identifiable information if it was something like
bob [dot] jonesatbritishairways [dot] com, ie we know their name and where they work.

I need to go back into battle on this one. My understanding is that a clear
privacy statement at the point of data collection indicating that the email
address would be used for the purposes of recommending the site only is
sufficient. This could be combined with a similar statement on the
recommendation email. (both as per DMA guidelines on electronic commerce)

Any thoughts greatly appreciated.
