I always design/develop comps in Photoshop and/or Illustrator/Freehand.

A "main" level and a "secondary" level to show what the rest of the sites
should look like.

In Flash, if the client wants animation, they're putting me on the clock.
Not trying to be abrupt, but I won't make anything live until they agree to
a contract or have signed-off on a comp.

It's always your option, but there's always something you can show them and
say "this is something animated"...blah blah. "Yours can be this way once
you sign on this dotted line."

But, that might just be me.
