My understanding was always that it is based on knowledge. Demon were in the
clear until it was established that the publisher may have been aware of the
libellous posting but had not taken steps to have comments removed.

I wonder what the libel situation is here? Can the 'publisher' be held
liable for any (libelous) remarks posted in an open forum? And would a
web-based forum be different from a newsgroup?

I know demon was taken to court over a newsgroup posting, but I can't
remember the outcome...
